Customer filed two 1st-party claims with State Farm (second claim #38-71Q7-94Z01) and had two deductibles taken out. State Farm took overlap off both estimates that lessened State Farm's payouts, but did not lower or waive either deductible. A different appraiser paid some of the overlapped items on a supplement but did not pay for the calibrations required for each claim. In addition, we submitted invoices for calibration and were denied. State Farm is paying off a quote they provided from a vendor in a different area. Additionally, State Farm refuses to pay for non included operations per the CCC motor guide. (State Farm and Brandywine Coach Works use the same estimating guide). In conclusion: 1. If State Farm is collecting two deductibles on two separate claims, they owe for two completely separate estimates without taking any common overlap. 2.State Farm did not honor our paid-out calibration invoices, but only paid according to a quote they received from a vendor that is not in our area, and that we do not use, saying that they "pay what is competitive in the market area". 3.State Farm blatantly refuses to pay for operations that are listed as not included in CCC. When asked why, their response is that they pay what is competitive in the area. I provided documentation showing that we are owed for those operations. I requested documentation from State Farm to outline where the law specifies that they are only required to pay "competitive rate" and who dictates what is considered "competitive". I was informed there is no legal verbiage giving insight as to what is considered "competitive" and that if their State Farm approved shops can do the repair without certain operations then we don't deserve to be paid for them regardless of whether or not they are listed as required or not included. Please have one of your staff lawyers review this complaint and also call me so I can discuss this problem.
